NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW OR REGULATION. ENTRANT MUST BE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY (EXCEPT ENTRANTS IN AL AND NE WHO MUST BE 19 YEARS OF AGE OR OLDER). SEE BELOW FOR OTHER ENTRY RESTRICTIONS.The American Campus Communities Custom Kicks Giveaway (“Sweepstakes”) is offered by ACC Op Acquisitions LLC (“Sponsor”) pursuant to these Official Rules. By participating in this Sweepstakes, you unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. All federal, state and local laws and regulations apply.
By entering this Sweepstakes, you are providing your personal information to Sponsor. Your personal information will only be used in accordance with the Sponsor’s respective privacy policies (see Paragraph 10).
1. Sweepstakes Entry Period:
The Sweepstakes begins Monday, March 16, 2026, at 12:00:01 a.m. Eastern Time ("ET") and ends Monday, April 6, 2026, at 11:59:59 p.m. ET (the “Entry Period”). The Sweepstakes Administrator’s (defined below) database clock will be the timekeeper for the Sweepstakes. Entry in the Sweepstakes does not constitute entry into any other game, sweepstakes or contest.Potential winners will be randomly selected to instantly win one of five (5) digital gift cards described in Paragraph 5 below (“Prizes”). Potential winners will be selected by an automated system that randomly identifies entries upon receipt of a unique Code, as explained in Paragraph 4 below.
2. Eligibility:
The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) (nineteen (19) in AL and NE) years of age and who are not residents or leaseholders at one of the participating communities operated by ACC and listed in Paragraph 15 (“ACC Communities”) at the time of entry. Sponsor, each of their members, subsidiaries, affiliates, advertising and promotion agencies, wholesale distributors and retail licensees, and any of their respective employees, officers, directors, agents and representatives (collectively, “Related Parties”), as well as any immediate family (spouse, parents, siblings, and children and their respective spouses) and household members (whether or not related) of any of the foregoing individuals, are not eligible, regardless of where they reside.3. How to Enter:
There are two ways to enter, described below. Entry must be completed during the Sweepstakes Period. One entry per person. Means of entry does not impact chances of winning.Entry option one: Complete the required portions of the online entry form at AmericanCampus.com/Custom-Kicks-Giveaway-Entry by the end of the Sweepstakes Period
Entry option two: Send an email to Sweepstakes@AmericanCampus.com with “Custom Kicks Giveaway” in the subject line and the following information in the body of the email: (1) full name, (2) age, (3) email address, (4) phone number, and (5) the participating market and university that the entrant resides at.
Automated or robotic Entries will be disqualified. Entries must be made by the Entrant directly and not by any person or entity acting or purporting to act on the Entrant’s behalf. Any attempt by Entrant to submit more than one entry by using multiple/different email addresses, identities, Instagram accounts, or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void each entry submitted by that Entrant and that Entrant will be disqualified. Tampering with the entry process is prohibited. Final eligibility for the award of the Prize is subject to eligibility verification as set forth below. All Entries must be visible to or received by Sponsor before the expiration of the Sweepstakes Period in order to be eligible. Entries become the sole property of Sponsor. Sponsor not responsible for any Entries that are delayed by an email system or delayed in posting to Instagram due to any delivery disruptions, computer or network disruption, malfunction or otherwise. Entrant is solely responsible for any expenses that may be incurred in connection with entering the Sweepstakes.
4. Winner Selection and Notification:
The winner will be selected in a random drawing from among all eligible entries received at any time during the Sweepstakes Period. The random drawing will be conducted within a week after the Sweepstakes Period closes. The random drawing will be done by Sponsor or its designated representatives, whose decisions are final.In the event that a potential winner is disqualified, deemed ineligible, forfeits the Prize or is deemed to have forfeited the Prize, as determined solely by Sponsor, Sponsor or its designee may – at Sponsor’s sole discretion -- conduct another random drawing to identify a new potential winner.
The potential winner will be notified by email at the email address provided by the Entrant no more than 15 days after the Sweepstakes Period ends. To claim a Prize, the potential winner must provide proof of winner’s age, residency and legal status as of the time of entry; and sign and return eligibility, publicity and any other releases requested by Sponsor. The potential winner must (1) accept the Prize by return email, as instructed by Sponsor in the notification email, within seven (7) days of the date that Sponsor sends the notification, and (2) provide Sponsor with all required documents within fourteen (14) days of the date that Sponsor sends the notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or the potential winner’s failure to adequately monitor any email or Instagram account.
Any winner notification not responded to or returned as undeliverable may result in Prize forfeiture.
Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes. Sponsor may be reached by email at sweepstakes@americancampus.com during the Sweepstakes Period.
5. Prizes/Odds of winning:
Prizes consist of digital gift cards. There are a total of 5 gift cards available as Prizes. The amount of each individual gift card is $200 USD. Only one prize per entrant.
Odds of Winning: Odds of winning a Prize depend on several variables, including the number of Eligible Entry Confirmation forms received during the Winner Selection Period, the number of Eligible Entry Confirmation forms received each day, and a computer program that randomly selects instant winners throughout the Winner Selection Period until all 5 Prizes are awarded.
No transfer or substitution of a Prize by a winner is permitted. Sponsor in it sole discretion may make prize substitutions.
Sponsor will send Digital Gift Cards to the email included in the Eligible Entry Confirmation form within ten business days of the close of the Winner Selection Period. Potential winners have ninety (90) days to claim their gift cards. If a potential winner fails to claim the gift card within ninety (90) days, the Prize is forfeited.
The use of any Prize manufacturer/supplier, name or trademark in connection with any of the Prizes is solely for the purpose of describing such Prize and is not intended to suggest any affiliation or sponsorship.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
6. Winner Requirements:
Acceptance of any portion of a Prize shall constitute each Winner’s agreement and consent to Sponsor’s and its designees’ use of Winner’s name (First initial/Last Name), state, likeness, photo, avatar, and/or prize information in connection with this Sweepstakes for promotional, advertising or other purposes, in any manner, worldwide, royalty-free, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.7. Release of Liability / Conditions of Participation:
A. Transmission of Information. Related Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines, email services, wifi or internet services, or network hardware or software; (3) unauthorized human intervention in any part of the entry process or this Sweepstakes; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Sweepstakes, the uploading, the processing or random selection of Sweepstakes Winners, the announcement of the Prizes or in any Sweepstakes-related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or; (6) costs associated with claiming or redeeming the Prizes; nor (7) loss or damages resulting from an entrant’s connection to the internet via any of the websites contained herein. Related Parties are not responsible for any incorrect, mis-transcribed, misdirected or undeliverable entries, E-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor assumes no responsibility for late, lost, incomplete, inaccurate, or damaged entries, or undeliverable E-mails resulting from any form of active or passive E-mail filtering by a user's Internet service provider and/or E-mail client or for insufficient space in user's E-mail account to receive E-mail. Sponsor does not accept responsibility for any damage (whether material or non-material) caused to Entrants, to their computer equipment or to data which is stored on them, or to their personal, professional, or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor or Administrator.B. Reservation of Rights. Sponsor reserves the right to cancel, suspend, and/or modify this Sweepstakes, or any part of it, if any fraud, technical failures, or any other factor impairs the integrity or proper functioning of this Sweepstakes, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine winner from among all non-suspect, Eligible Entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor. Administrator, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. The preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights. Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance does not constitute the waiver of such provision.
C. Release and Indemnity. By participating, Entrant indemnifies, releases and agrees to hold harmless the Related Parties and other entities involved in the development / production / administration of the Sweepstakes, and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or acceptance, receipt, possession or use/misuse of any Prize and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery.
8. FORCE MAJEURE.
If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned by reason of computer virus, bug, system malfunction, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, pandemic, governmental regulation or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct a Sweepstakes drawing from the remaining Eligible Entries prior to the Sweepstakes being discontinued
9. DISPUTE RESOLUTION/GOVERNING LAW:
To the fullest extent permitted by law, by participating in the Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or this Sweepstakes shall be filed exclusively in the federal or state courts of the state of Texas, and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action; (b) any such action shall be resolved individually, NOT as part of a class action; (c) any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred in Entrant’s entry into the Sweepstakes (if any), but NOT attorneys’ fees, special damages, punitive damages, or consequential damages of any kind (including lost wages). These Official Rules and this Sweepstakes shall be governed by the laws of the State of Texas in Travis County, without regard to principles of choice of laws/conflict of laws of the State of Texas or of any other jurisdiction.
10. Use of Data. Entrant’s Personal Information:
Sponsor (Sponsor, together with its affiliates, “ACC”) will be collecting personal data about Entrants online, in accordance with their respective privacy policies, as well as the terms of these Official Rules. Please review ACC’s privacy policy at https://www.americancampus.com/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree to the collection and usage of their personal information and acknowledge that they have read and accepted ACC’s privacy policies. Notwithstanding the foregoing, all Entrants acknowledge that if they are chosen as a Winner, certain of their personally identifying information may be disclosed to third parties, including, without limitation, on a winner’s list. All personal information submitted as part of the Sweepstakes may be shared by and between the Related Parties and their affiliates and partners, and such affiliates and partners will use disclosed personally identifying information in accordance with their respective online privacy policies.
11. Social Network Disclaimer:
The Sweepstakes may be held, hosted, or promoted on social media platforms including but not limited to TikTok, Twitter/X, Instagram, Facebook, and any of its affiliated sites (the "Media Platforms"). By participating in the Sweepstakes, you hereby agree to adhere to the Terms of Use, Privacy Policy and any other terms governing access to the Media Platforms, their servers, or their content. Sweepstakes is not sponsored or endorsed by the Media Platforms. By participating in this Sweepstakes, you agree to release the applicable Media Platforms from any claims, liabilities, or damages arising out of or in any way connected with this Sweepstakes. Except where prohibited by law, entry and acceptance of Prize constitute permission to use Winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.12. Taxes/Expenses:
Federal, state and local taxes are the sole responsibility of the Winner, and Winner is responsible for any reporting obligations. Questions related to taxes, should be directed to your personal tax advisor.13. Winners List:
To learn the name of the winner or to obtain a copy of these Official Rules, send your request along with a self-addressed envelope to Sponsor at the address below. Requests for the name of the winner must be received no later than 60 days after the Sweepstakes Period has ended.
