IMPORTANT LEGAL NOTICE — PLEASE READ CAREFULLY
THESE SMS/TEXT TERMS CONTAIN IMPORTANT PROVISIONS AFFECTING YOUR LEGAL RIGHTS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ACC EACH WAIVE THE RIGHT TO A TRIAL BY JURY, AND YOU AGREE THAT CLAIMS ARISING OUT OF OR RELATING TO THESE SMS/TEXT TERMS OR THE ACC SMS/TEXT PROGRAMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THESE SMS/TEXT TERMS ALSO CONTAIN LIMITATIONS OF LIABILITY AND OTHER TERMS THAT MAY LIMIT OR AFFECT YOUR RIGHTS AND REMEDIES.

1. INTRODUCTION
This SMS/Text Messaging Consent and Terms (“SMS/Text Terms”) governs your participation in text messaging programs offered by American Campus Communities (“SMS/Text Programs”). The SMS/Text Programs are operated by American Campus Communities, Inc. and its affiliates, subsidiaries, and related entities (collectively, “American Campus Communities,” “ACC,” “we,” “our,” or “us”).
By enrolling in the SMS/Text Programs, you agree to these SMS/Text Terms.
2. PROGRAM DESCRIPTION
ACC SMS/Text Programs may include one or more of the following categories, as described when you enroll: promotional or marketing messages; community or property information; account, application, lease, payment, maintenance, or other transactional information; and emergency-purpose health or safety communications.
Your messaging choices and any later opt-out apply to messages for which ACC relies on your consent. ACC may send a text message without consent only to the extent applicable law permits the message to be sent without consent.
SMS/text messages may include courtesy reminders concerning lease or community matters, but these SMS/Text Terms do not make text messaging a legally sufficient method of delivering any notice that applicable law or your lease requires to be delivered by another method.
3. ENROLLMENT & CONSENT
To enroll in an SMS/Text Program, you must provide a mobile telephone number, review the consent disclosure for that program and sender, and affirmatively agree to receive the applicable messages. ACC may send a text message to the number you provide for the purpose of confirming that number and completing your enrollment. If instructed to do so, you must reply START [or JOIN] to complete enrollment. ACC will not begin sending recurring messages under that enrollment unless the required confirmation is received.
By completing enrollment, you authorize the ACC entity or entities identified in the applicable consent disclosure to send recurring text messages to the mobile number you provided, for the message categories you selected.
If you elect to receive marketing or promotional text messages, your consent includes authorization to receive advertising and telemarketing text messages sent using an automatic telephone dialing system or other automated technology. Your consent to receive marketing or promotional text messages is not a condition of applying for, renting, leasing, purchasing, or receiving any property, goods, or services from ACC.
4. MESSAGE FREQUENCY AND CHARGES
Message frequency varies by SMS/Text Program, the preferences you select, and your interactions with ACC. You may receive recurring messages as well as additional messages triggered by your requests, account activity, or community or property events. The message-frequency disclosure presented when you enroll in a particular program will apply to that program.
Message and data rates may apply. Contact your wireless carrier for information concerning your messaging and data plan.
5. OPTING OUT
You may revoke your consent to receive consent-based ACC SMS/text messages at any time by any reasonable method that clearly communicates your desire not to receive further messages. For example, you may reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to an ACC SMS/text message. You may also communicate an opt-out request through another reasonable method, including the customer-support channels described below.
ACC will process opt-out requests promptly and within the time required by applicable law. You do not have to use a particular word or method if your communication otherwise clearly expresses a request to stop receiving text messages.
If you participate in more than one ACC SMS/Text Program or message category, ACC will determine the scope of your request based on the words and context of your request and applicable law. If the scope of your request is unclear, ACC may send one non-marketing text message confirming your request and, where permitted, asking you to clarify which messages you wish to stop.
After your consent has been revoked, ACC will not send additional text messages that require that consent unless you later provide new consent or specifically request the message. ACC may continue to send a message only to the extent applicable law permits that message to be sent without the revoked consent, including where applicable a communication necessary for a health or safety emergency.
6. HELP AND CUSTOMER SUPPORT
For help, reply HELP to any ACC SMS/text message. You may also contact Customer Support by calling 512-732-1099 or emailing apartmentinfo@americancampus.com.
Replying HELP by itself does not opt you out. To opt out of eligible text messaging programs, reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to an ACC SMS/text message or use another supported opt-out method described above. If you communicate an opt-out request through Customer Support, ACC will process the request in accordance with applicable law.
7. PRIVACY/TERMS USE
ACC's collection, use, and disclosure of personal information in connection with the SMS/Text Programs are described in our Privacy Policy and incorporate by reference herein.
ACC does not sell or share your mobile telephone number, SMS opt-in information, or SMS consent status with third parties or affiliates for their own marketing or promotional purposes. ACC may disclose such information to service providers that assist ACC in operating the applicable SMS/Text Program and as otherwise permitted or required by law.
ACC's general Terms of Use govern your use of ACC websites and online services. Your optional consent to receive marketing text messages is separate from that agreement and is not a condition of obtaining ACC property, goods, or services.
8. CARRIER LIABILITY AND MESSAGE DELIVERY
SMS/text messaging may not be available through all wireless carriers, devices, or service plans. Message delivery is not guaranteed and may be delayed or unsuccessful because of carrier, network, device, service-provider, or other technical conditions. Wireless carriers are not liable for delayed or undelivered messages.
9. MOBILE NUMBER CHANGES
You represent that you are the subscriber or customary user of the mobile telephone number you enroll, or that you otherwise have authority to provide consent for text messages to that number. You must not enroll a telephone number that you are not authorized to use for this purpose.
If you change, transfer, or relinquish your mobile telephone number, please notify ACC promptly at by calling 512-732-1099 or emailing apartmentinfo@americancampus.com. If possible, reply STOP to an ACC text message before relinquishing the number.
10. GENERAL
Updates. We may update these SMS/Text Terms from time to time. The revised SMS/Text Terms will identify their effective date and will apply prospectively. ACC will provide any notice of changes required by applicable law.
Scope. ACC will not use an amendment to these SMS/Text Terms to materially expand the scope of your marketing consent, authorize a new marketing sender, or obtain any consent that applicable law requires you to provide affirmatively. Where new or additional consent is legally required, ACC will obtain that consent before sending the affected messages.
Modification. ACC may modify, suspend, or discontinue an SMS/Text Program, subject to applicable law. ACC may also cease sending messages if service to your mobile number terminates, the number becomes unavailable, or continued messaging is not reasonably practicable.
Termination. We may suspend or terminate your receipt of ACC SMS/text messages if we believe you are in breach of these terms. Your receipt of ACC SMS/text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. We reserve the right to modify or discontinue, temporarily or permanently, all or any part of ACC SMS/text messages, with or without notice.
Severability. If any provision of these SMS/Text Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
Assignment. You may not assign your rights or obligations under these SMS/Text Terms without ACC’s consent. ACC may assign or transfer its rights and obligations under these SMS/Text Terms in connection with a merger, acquisition, reorganization, sale of assets, transfer of a property or business, or similar transaction, subject to applicable law. No assignment will expand the scope of your consent to receive marketing or promotional text messages beyond the scope permitted by applicable law.
Relationship to Other Agreements. These SMS/Text Terms govern your participation in the applicable ACC SMS/Text Programs and supplement any other agreement between you and ACC. ACC’s Privacy Policy describes ACC’s collection, use, and disclosure of personal information. ACC’s website Terms of Use separately govern use of ACC websites and online services.
Conflicts. If these SMS/Text Terms conflict with another ACC agreement regarding the sending of SMS/text messages or your consent to receive them, these SMS/Text Terms will control with respect to that subject, except to the extent the other agreement expressly provides otherwise or applicable law requires otherwise.
No Modification. Nothing in these SMS/Text Terms modifies the requirements for delivery of notices under your lease or applicable landlord-tenant law.
Disclaimer. THE SMS/TEXT PROGRAMS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACC DISCLAIMS WARRANTIES REGARDING THE AVAILABILITY, RELIABILITY, TIMELINESS, OR ERROR-FREE OPERATION OF THE SMS/TEXT PROGRAMS.
11. DISPUTE RESOLUTION; WAIVER OF RIGHT TO CLASS ACTIONS; WAIVER OF RIGHT THE JURY TRIAL
Important: This section impacts certain legal rights and includes a waiver of the right to participate in any form of class, mass, collective, or representative action, your right to trial by jury, and limits your ability to obtain certain remedies and forms of relief. Please review carefully.
Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SMS/TEXT PROGRAMS, INCLUDING DAMAGES RESULTING FROM DELAYED, FAILED, MISDIRECTED, OR UNDELIVERED MESSAGES.
NOTHING IN THESE SMS/TEXT TERMS EXCLUDES OR LIMITS ANY LIABILITY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Class or Collective Action Waiver. You agree that you will not sue ACC as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class or collective action lawsuit against ACC. Nothing in this section, however, limits your rights to bring a lawsuit as an individual plaintiff.
WAIVER OF JURY TRIAL. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ACC EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, CLAIM, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE SMS/TEXT TERMS, YOUR ENROLLMENT IN OR PARTICIPATION IN ANY ACC SMS/TEXT PROGRAM, YOUR CONSENT OR ALLEGED CONSENT TO RECEIVE SMS/TEXT MESSAGES, YOUR REVOCATION OR ALLEGED REVOCATION OF SUCH CONSENT, OR ANY SMS/TEXT MESSAGE SENT OR ALLEGEDLY SENT BY OR ON BEHALF OF ACC. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY SUCH ACTION, CLAIM, PROCEEDING, OR COUNTERCLAIM WILL BE TRIED TO THE COURT AND NOT TO A JURY.
Applicable Law and Jurisdiction. Except to the extent governed by applicable federal law or otherwise required by applicable law, these SMS/Text Terms will be governed by and construed in accordance with the laws of the State of Texas without regard to its conflict-of-laws principles. The parties agree that any dispute arising from or relating to any SMS/Text Program or these SMS/Text Terms shall be governed and construed in accordance with the laws of the State of Texas, excluding conflict of laws rules, and that any action based on or alleging a breach of these provisions must be brought exclusively in a state or federal court located in Austin, Texas. Both parties agree to submit to the personal jurisdiction and venue of state and federal courts located in Austin, Texas.
